Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ThermalVariations platform (the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.

1. The Service

ThermalVariations analyses aerial thermal imagery of solar installations using automated detection models and produces severity-ranked fault reports. The Service is a screening and prioritisation tool for trained operators and asset managers.

2. Important: analysis is indicative, not diagnostic

Thermal analysis identifies likely anomalies. It is not a substitute for on-site inspection by a qualified professional. You acknowledge and agree that:

• Reports are generated by automated models and may contain false positives (modules flagged that are healthy) and false negatives (faults that are not flagged).
• Detection quality depends on the quality, resolution, altitude, conditions and calibration of the imagery you supply.
• You must verify all flagged modules on site, by a suitably qualified person, before undertaking repair, warranty or electrical work.
• The Service does not provide electrical, engineering, safety or financial advice, and reports must not be relied on as such.

3. Your content and responsibilities

• You retain ownership of all imagery you upload. You grant us a limited licence to store and process it solely to provide the Service to you.
• You warrant that you have all necessary rights, consents and approvals to capture and upload the imagery, including any aviation (CASA), property access and privacy approvals applicable to your drone operations.
• You are responsible for the accuracy of the site details you provide (panel counts, wattage), which determine your quote.
• You must keep your account credentials secure and must not share your account.

4. Acceptable use

You must not:

• Upload content you do not have rights to, or content that is unlawful, malicious or infringing.
• Attempt to access another customer's data or probe, scan or test the security of the Service without written authorisation.
• Reverse engineer, scrape or resell the Service except as expressly permitted.
• Use the Service to violate any applicable law or regulation.

5. Fees and payment

• Pricing is quoted per inspection based on site size, with a published rate and minimum fee shown before you commit.
• A 20% deposit is payable before uploading and analysis begin. The balance is payable before report download.
• Payments are processed by Stripe. All amounts are in Australian dollars and include GST where applicable.
• Because analysis costs are incurred when processing runs, deposits are non-refundable once analysis has commenced, except as required by law or where we fail to deliver the Service.

6. Availability

We aim for high availability but the Service is provided on an "as is" and "as available" basis. We may suspend the Service for maintenance, security or operational reasons. We do not guarantee uninterrupted or error-free operation.

7. Intellectual property

We own all intellectual property in the Service, including the detection models, software and report formats. Reports generated for you may be used freely for your business purposes. Nothing in these Terms transfers ownership of our IP to you, or of your imagery to us.

8. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that:

• To the maximum extent permitted by law, we exclude all liability for indirect, incidental, special or consequential loss, including loss of profit, loss of revenue, loss of energy yield, equipment damage, fire, electrical failure or business interruption, arising from or in connection with the Service or any report.
• Our total aggregate liability for any claim arising out of or in connection with the Service is limited to the amount you paid us for the specific inspection giving rise to the claim, or where liability cannot be so limited, to resupplying the Service.
• We are not liable for any loss arising from your failure to verify flagged modules on site, from reliance on the report as a sole basis for any decision, or from faults present in modules the model did not flag.

9. Indemnity

You indemnify us against any claim, loss or expense (including reasonable legal costs) arising from your breach of these Terms, your unlawful capture or upload of imagery, or your drone operations, except to the extent caused by our negligence.

10. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that breach these Terms or create security risk. On termination, clauses relating to liability, indemnity and intellectual property survive.

11. Governing law

These Terms are governed by the laws of Australia and the state of the proprietor's principal place of business. The parties submit to the non-exclusive jurisdiction of the courts of that state.

12. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
